These Terms of Service ("Terms") govern your use of the Pushr.me website and services (“Service”), provided by Pushr.me ("we", "our", or "us"). By using our website or creating an account, you agree to these Terms.

If you do not agree with any part of these Terms, you must not use Pushr.me.

1. Account & Eligibility

To use Pushr.me, you must:

• Be at least 13 years old (16 in the EU)
• Have legal authority to enter into this agreement
• Provide accurate and complete information when creating your account

You are responsible for all activity that occurs under your account.

2. Our Service

Pushr.me provides a cloud-based platform that allows users to:

• Collect web push notification subscribers
• Send notifications to those subscribers
• Use dashboards, automation tools, and API integrations
• View subscriber analytics and campaign stats

We may modify or discontinue certain features at any time.

3. Free vs Paid Plans

You may use Pushr.me on a Free plan or upgrade to a Paid plan for additional features and higher limits.

• Free plans have defined usage caps (e.g., subscribers, notifications)
• Paid plans are billed monthly or annually depending on your selection
• Custom plans are available by contacting us directly

4. Billing & Payments

• All paid plans are billed in advance.
• Payments are non-refundable unless otherwise required by law.
• You may cancel or downgrade at any time, and changes will apply to your next billing cycle.
• We reserve the right to suspend accounts for failed payments or excessive usage outside your plan.

5. Acceptable Use

You agree not to use Pushr.me to:

• Send spam, deceptive, or abusive content
• Violate any laws or third-party rights
• Disrupt, overload, or harm our infrastructure
• Attempt to reverse engineer, copy, or resell our service

Violations may lead to suspension or termination of your account.

6. Subscriber Responsibility

You are solely responsible for:

• Gaining proper consent before sending notifications
• Complying with applicable privacy laws (e.g., GDPR, CCPA)
• Managing your subscribers’ data and preferences responsibly

Pushr.me only acts as a processor of the data you collect.

7. Data & Privacy

We collect and process data as described in our Privacy Policy. You retain full ownership of your data. We never sell your subscriber data to third parties.

8. API Usage

If you use our API:

• You agree to follow fair usage limits (unless otherwise agreed)
• Abuse of the API (e.g., spamming, scraping, DDoS) will result in suspension

We may monitor API activity for security and performance purposes.

9. Termination

You can cancel your account at any time from your dashboard or by contacting us.

We reserve the right to terminate your account if:

• You violate these Terms
• Your actions harm other users or our platform
• Required by law or regulatory notice

Upon termination, your access will be revoked and your data may be deleted after a retention period.

10. Intellectual Property

Pushr.me and its logo, platform design, and source code are our property. You agree not to copy, modify, or reuse any part of our brand or technology without permission.

11. No Warranty

We provide the service “as is”, without any express or implied warranties.

We do not guarantee:

• 100% uptime or uninterrupted access
• That Pushr.me will meet your exact expectations
• That your use of the platform will lead to specific results

12. Limitation of Liability

To the maximum extent permitted by law, Pushr.me will not be liable for:

• Lost profits or revenue
• Data loss or corruption
• Indirect, special, or consequential damages

Our total liability for any claim is limited to the amount you paid in the last 3 months.

13. Modifications

We may update these Terms from time to time. If we make significant changes, we’ll notify you via email or the platform. Continued use after changes means you accept the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to any principles of conflicts of law that would result in the application of the laws of another jurisdiction. By using Pushr.me, you agree that any disputes, claims, or legal proceedings arising out of or relating to these Terms or your use of the Service shall be exclusively subject to the jurisdiction of the Danish courts.
